Live Coverage: WI v. Kyle Rittenhouse – Kenosha Shooting
Day 2 Jury Began Deliberations at 10:15am ET
Jury Question: Do we view videos in courtroom or in private? Judge Schroeder asks “any suggestions?” Binger says he believes the law is clear they have to watch it in the courtroom

Judge Schroeder & Counsel Discuss Drone Footage

REMINDER of the judge’s ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.

Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.

Charges:
1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
fired)
3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
Grosskreutz)
6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government – Emergency Management Activity (citation, carries no penalty) – everyone present was breaking the 7pm curfew issued by the sheriff.

Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)

JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)

Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.

Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.

Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

It’s not fair to the “process “ as the prosecutors say so to the judge . The jury is not respected anyway – dismissal should occur – judge warned harshly the other day with warnings & emphasizing they view wo restriction and explanations- Motion to dismiss!

Don’t trust the public prosecutors, they are crooked.

airdropping is NOT secure, Fox news should have been subpoenaed to provide the original person and the original file should have been copied. Sending via email will auto-compress files, this occurs prior to the email being sent and is done by the email client. It should have been supplied on USB or other ‘hard’ media. The 2nd method (putting it on a thumbdrive) should have been the correct procedure.

4 Millibytes do not exist, it is not a legit measurement. If it was 4kb then it should have been obvious there had been compression, if it was 4MB then it would also indicate it may have been compressed. 3x compression is not unusual (in fact it is typical). The fact that she gets these basic measurements wrong shows she has no idea of how these things work. Saving this mutliple times will not change anything. FFS get some basic education on using computers people.

Dropbox does NOT provide a forensic copy of a file, it copies the file so the copy should be the same, however sectors of the device used will be different. In other news sometimes the connection software (on Apple or on PC) will truncate the name of a file if it goes beyond 8 characters (excluding file extension). SO that the copy can be read using different (older) operating systems.

Fox News made the drone fly over that night and recorded the footage of actual event on that night – prosecutors knew they toyed with the footage time in discovery phase. The State gave 4 seconds video in discovery for all to view when it was really 11 seconds long ; The prosecutors lied then & in the courtroom everyday of the trial – the jury cannot receive explanation of what is seen on the 11 second video by the defense now – this is clearly criminal on the part of the state prosecutors!

Courts must remain independent from government operated system. There needs to be invention by the courts in censorship issues by technology companies. Companies are guilty of using censorship to promote their own hidden agenda’s. New laws must be introduced to protect a citizens right to freedom of speech. No person in the United States should be banned from websites unless they have been criminally charged by the police and found guilty in a court of law. Technology companies are not the judge and jury. They have no right to censor anyone.

Older email systems will not allow email attachments over 10Meg. If the file was 11 meg it might not go from one email service to another or perhaps even within a service. If it was gmail to gmail 11M is fine. the limit is 25M. But this was an mov file not a compressed .zip or something. It might be that one file is what the drone transmitted and the other is what it recorded to it’s internal storage.

Don’t tell me they are arguing about a video quality. If i can figure out air drop then lawyers should too. Especially in a case that the whole world is watching.

  23. Ali Thomas on December 19, 2021 at 12:26 pm

I hope they show these prosecutors on the stand.

  24. Chu Tuoc on December 19, 2021 at 12:27 pm

The police and the prosecutor did not take the video and hide it until the last day. It’s the video published by other sources and it’s out there in public so everybody who has internet can see. So unfortunately, "some" individual may got trigger because of it, but it’s technically not a violation of court procedure… Sorry. If it’s the clear violation, the judge should already made a decision and not just keep the defendant request as consideration. Anyway, I love how people wining about "political" bla bla bla by the media while repeating the same thing they watch on Fox. Doesn’t it kinda undermine your own argument???

  25. Daniel Sumi on December 19, 2021 at 12:27 pm

NFT’s would have been useful here

  26. Doc Holliday on December 19, 2021 at 12:28 pm

Its hilarious listening to someone who knows 0 about technology try to lie about it. They clearly sent the low quality video on purpose. Email doesnt auto compress videos if they go over the file limit size it will simply just reject it and let you know. Also 11mb wont be over an emails file limit size. Also itd be their email not hers compressing it. Also the woman is correct. The filename being different clearly indicates they sent the lower quality video on purpose. Nothing would have auto changed the filename in that process.

  28. Random Task on December 19, 2021 at 12:31 pm

Changing a filename does not alter its contents. It remains bit identical. Comparing file hashes is the way to prove if they are identical or not. Basic IT stuff. Scary that they don’t know this and are tossing files around like confetti.

Why don’t they provide sha256 checksums?? If they did this, everyone can PROVE a perfect data integrity… You can even use it to prove the jury is being presented a perfect match of the evidence files

  32. Donna Steffes on December 19, 2021 at 12:36 pm

    Prosecutors are criminals

  33. Scott Ickes on December 19, 2021 at 12:38 pm

the guy with the dark earrings with a gun from start to finish was in every video even the drone footage pointing his weapon. Over a hundred people trying to cut off and help or wanted to see violence until gunshots were fired. I’m not going to be upset either way this trial goes. Guns don’t kill people .

  43. MarkA420 on December 19, 2021 at 12:50 pm

I don’t know why the prosecution were so keen on allowing the jury to view the footage as much as they wanted … I think that could have been a major factor to the not guilty verdicts because they could rewind, pause etc as many times as they wanted and that makes it far easier to pinpoint each act of self defence.

  44. 机器人.dk on December 19, 2021 at 12:51 pm

The judge is withholding his ruling on the defense’s motions for a mistrial until the jury has reached a verdict. If they find him guilty of anything, he will declare it a mistrial.

  45. Donna Steffes on December 19, 2021 at 12:52 pm

It’s evidence, how are they allowed to air drop or email anything. It should be at the first point of contact physical transfer. Everyone knows email transfer can compress files that’s why people use drop box etc.
